Terms of Service
These terms govern your use of the Kafka Streamyard website, desktop application, trial, licensing, and related services.
1. Who we are
Kafka Streamyard is operated by FinnStream Oy in Finland. In these terms, “FinnStream Oy”, “FinnStream”, “Kafka Streamyard”, “we”, “us”, and “our” mean the operator of the Kafka Streamyard website, desktop application, licensing services, and related support channels.
By using the website, downloading the app, starting a trial, purchasing a license, or contacting us through the service, you agree to these Terms of Service.
2. The service
Kafka Streamyard is a desktop software product and related website for working with Kafka data, including manual testing, streaming, topic inspection, filtering, imports, exports, and operational workflows.
We try to keep product descriptions, features, compatibility notes, trial information, and pricing accurate. We may improve, patch, update, suspend, or discontinue parts of the service for reasons such as security, legal compliance, bug fixes, infrastructure changes, supplier changes, or product improvement.
3. Accounts, sign-in, and trial access
Certain features require you to provide an email address and use a one-time passcode sign-in flow. Your email address acts as your product user ID and license identity, so you must provide accurate information and use an email account that you control.
The desktop app may offer a free trial before purchase. Trial eligibility, trial duration, device limits, and access rules are determined by the product configuration shown on the website or in the app at the time of use.
You are responsible for activity under your email account and for keeping access to your devices reasonably secure.
4. License terms
Unless a separate written agreement says otherwise, a paid self-serve desktop license for Kafka Streamyard is granted to a single named user for personal and commercial use, subject to the plan shown at checkout.
- The license is personal to the purchaser or named user and may not be resold or sublicensed.
- Device and concurrent use limits may apply as shown on the pricing page or in the app.
- You may not copy, distribute, or make the product available to third parties except as expressly allowed by law or by a separate written agreement with us.
- You may not attempt to bypass licensing, access controls, or security protections.
5. Consumers, digital content, updates, and remedies
If you are a consumer, nothing in these terms limits your mandatory rights under applicable consumer law. Where required by law, the paid digital content or digital service must conform to the contract and to mandatory legal requirements relating to functionality, compatibility, security, and other expected characteristics.
Where required by law, we will provide updates that are necessary to keep the digital content or digital service in conformity, including security updates. If the digital content or service does not conform, your remedies may include bringing the service into conformity, price reduction, termination, reimbursement, damages, or other statutory remedies depending on the law that applies to you.
6. Payments, taxes, and Paddle checkout
Payments for self-serve purchases are processed through Paddle. Paddle may act as merchant of record for your purchase. The hosted checkout shows the final total price, billing currency, and any applicable VAT, sales tax, GST, or similar indirect taxes before you place the order.
Unless we explicitly say otherwise, prices shown on the website are base software prices and may not include taxes that apply in your billing country. For customers in Finland and abroad, the tax treatment depends on the billing location and other information required by applicable law at checkout.
If tax law requires billing country, VAT number, business information, or other tax details to determine the correct tax treatment, you may be asked to provide that information in the hosted checkout or other billing flow we provide. We do not provide tax advice, and you remain responsible for your own tax reporting or deduction obligations.
You are responsible for providing a valid purchase email address. Because your email address acts as your product user ID and license identity, the purchase email should match the email you use in the app.
If a payment is declined, reversed, refunded, or flagged as fraudulent, we may suspend or revoke related paid access.
7. Right of withdrawal and cancellation
If you are a consumer, mandatory withdrawal or cancellation rights may apply under the law of your country. For consumers in the EU or EEA, this usually means a 14-day withdrawal period for distance contracts unless a statutory exception applies.
You can exercise a withdrawal or cancellation right by sending us a clear statement before the relevant deadline, for example by email to support@kafkastreamyard.com or by using the website contact form. Please include your product email address, order reference if available, and a clear statement that you wish to withdraw or cancel.
If we wish to rely on a statutory exception that can apply when digital content or a digital service begins before the withdrawal period ends, we will request any express consent and acknowledgement required by applicable law before that exception applies.
8. Refunds
Refunds for self-serve purchases are handled in accordance with our Refund Policy. If there is any conflict between these terms and the Refund Policy, the Refund Policy controls for refund-request procedure, but your mandatory statutory rights still apply.
9. Changes, updates, and availability
We may make changes to the service, including updates, security patches, technical adjustments, feature changes, or infrastructure changes. If a change materially and negatively affects paid consumer use in a way that gives you rights under applicable law, we will provide any notice, rights, or remedies required by that law.
We do not promise uninterrupted availability at all times, but we aim to operate the service with reasonable care.
10. Acceptable use
You agree not to misuse the website, app, or related APIs and services. This includes, for example:
- using the service in breach of applicable law or third-party rights;
- attempting to gain unauthorized access to systems, accounts, or data;
- interfering with service stability, availability, or security;
- using the service to distribute malware or harmful code; or
- using the product with data or systems you are not authorized to access.
11. Intellectual property and Kafka trademark notice
The Kafka Streamyard website, software, branding, text, design, and related materials are owned by FinnStream Oy or its licensors and are protected by applicable intellectual property laws. Except for the limited right to use the product under these terms, no ownership rights are transferred to you.
KAFKA is a registered trademark of The Apache Software Foundation and has been licensed for use by FinnStream Oy. FinnStream Oy has no affiliation with and is not endorsed by The Apache Software Foundation.
12. Third-party services
Parts of the service may rely on third-party providers such as payment, hosting, infrastructure, email delivery, or other technical services. Their services are governed by their own terms and privacy notices.
13. Disclaimers and limitation of liability
Except to the extent prohibited by law, and always subject to mandatory consumer rights, the service is provided on an “as is” and “as available” basis. We do not guarantee that the service will be uninterrupted, error-free, or suitable for every use case.
To the fullest extent permitted by law, FinnStream Oy is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities arising from your use of the service.
Nothing in these terms limits mandatory consumer rights or liability that cannot legally be excluded, including applicable rights relating to digital content, digital services, defects, conformity, updates, remedies, withdrawal, or mandatory statutory liability.
14. Governing law and dispute resolution
These terms are governed by the laws of Finland, excluding conflict of law rules, unless mandatory consumer protection law in your country of residence provides otherwise.
If you are a consumer and we cannot resolve a complaint directly, you may contact the Finnish Competition and Consumer Authority’s Consumer Advisory Services and, where eligible, the Consumer Disputes Board in Finland. Consumers should first raise the complaint with us directly.
